What is the structure of the United State's income tax system ...

I am a first time tax payer. I?ve seen the term ?tax structure? on a couple of tax forms. The term does not pertain to the forms ask any questions (search as taxable interest, Wages, salary, and tips, etc). But I?m curious to know: What is the structure of the United State?s income tax system?I have not found any resources that will give me a straight answer. Best answer:

With more than 10,000 pages in the Internal Revenue Code, the structure is far to complex to discuss here. Basically it as a tax on income with tax rates that high income earners Sun graduated pay a higher percentage than low-income individuals.

Too many colon tests use costly sedation: Study

CHICAGO (AP) ? Few people want to be wide awake during their colonoscopy exams, but new research suggests too many are getting extra sedation treatment, costing as much as $1 billion yearly in potentially needless services.

Use of anesthesiologists to monitor sedation during colonoscopies and other digestive imaging tests has more than doubled in recent years, and they're used most often for low-risk patients who typically don't need the extra help, the study authors said.

"These services are not harming patients. They're basically giving them a luxury that is not strictly necessary," said the study's lead author, Dr. Soeren Mattke, a senior Rand Corp. scientist. That matters at a time when policymakers are trying to rein in rising medical costs, the authors said.

Patients usually are briefly sedated for a colonoscopy, and some kinds of sedation require monitoring by specialists. That includes use of propofol, a powerful intravenous drug that can cause deep sedation and was implicated in pop star Michael Jackson's death. Anesthesiologist-monitored sedation, with or without propofol, is recommended for high-risk patients, including those who are old or sick or previously had complications with anesthesia.

While propofol sedation is also sometimes given to low-risk colonoscopy patients, the study authors suggest that's often unnecessary. Drugs usually recommended for these patients typically cause lighter sedation, though most patients don't remember anything about the exams afterward. These drugs can be given by the doctor doing the exam, but the study suggests they're often also being given and monitored by anesthesiologists.

The researchers analyzed insurance claims data on more than 6 million U.S. adults who had the colon exams or imaging scopes of the upper digestive tract between 2003 and 2009. The tests are done to screen for colon cancer, acid reflux and other illnesses.

When the study began, 14 percent of these tests included an anesthesiologist. That climbed to more than 30 percent by 2009. The portion of this extra sedation treatment given to low-risk commercially insured patients remained constant during the study and fell slightly in Medicare fee-for-service patients. But the study authors said far too many low-risk patients are still getting this treatment ? more than three-fourths of the commercially insured patients and two-thirds of the Medicare group.

The extra treatment added an average of about $500 to an insured patient's bill in 2009, and $150 to a Medicare bill. In 2009, about 3 million colonoscopies and other digestive scoping tests were done in low-risk patients but included anesthesia services, amounting to $1 billion in potentially unnecessary costs, the study authors estimated.

The study appears in Wednesday's Journal of the American Medical Association.

While some insurance policies exclude coverage for anesthesiologist monitoring for low-risk patients undergoing these exams, insurers sometimes pay for it, Mattke said.

Because of doctor backlash, Aetna, one of the nation's largest health insurers, has indefinitely delayed a policy it tried to implement in 2008 that would have excluded this coverage for low-risk patients, said Dr. James Cross, Aetna's chief of national medical policy and operations.

Reasons for the frequent use of anesthesiologists during these exams vary. Sometimes low-risk patients undergoing colonoscopies and other digestive scoping exams request propofol because they want to be totally unconscious and have heard that it wears off quickly and doesn't cause grogginess, unlike other sedatives, said Dr. John Vargo, a spokesman for the American Society for Gastrointestinal Endoscopy and a digestive specialist at the Cleveland Clinic.

Propofol requires careful monitoring because it has "a narrow window between providing deep sedation and making people stop breathing," and unlike other sedatives, there's no rescue drug to reverse its effects, said Dr. Norm Cohen, vice president for professional affairs at the American Society of Anesthesiologists.

The rising use of anesthesiologists may partly reflect more obese patients and users of Vicodin and other opiate-based prescription drugs, Cohen said. Both may be missed under coding used in the study, but they should be considered at risk because sleep apnea that often accompanies obesity makes sedation trickier, and users of opiate painkillers often require higher than usual doses of sedation, he said.

Vargo said doctors who do the exams can be trained to use propofol in healthy patients, but a journal editorial said some prefer anesthesiologist assistance because it allows them to focus on the colon exam, and if something goes wrong with the sedation, they may not be held legally accountable.

Dawn Meehan, 42, an Orlando, Fla.-area teacher's assistant and writer, had a colonoscopy last month under deep sedation monitored by an anesthesia specialist; her insurance covered everything. Colonoscopies to screen for colon cancer usually aren't recommended?until age 50 but Meehan had the exam because of symptoms for a common?digestive disease.

She was a low-risk patient and said if her colonoscopy doctor had offered it, she might have chosen light sedation. But even though the extra sedation is more costly, Meehan said patients who want it should get it, because otherwise some might "shy away from getting screened."

New York jail sued after five suicides in two years

NEW YORK (Reuters) - A civil liberties group filed a lawsuit on Wednesday accusing a New York county of poor oversight of a local jail where five inmates have committed suicide since 2010.

The New York Civil Liberties Union filed its suit in state Supreme Court against Nassau County, on Long Island, in light of the recent death of Iraq war veteran Bartholomew Ryan.

Ryan, 32, hung himself in February shortly after being jailed on a drunk driving charge, according to the lawsuit.

"We were so dismayed with the sorry state of affairs there, especially with the recent death of an Iraq War veteran, which is a tragedy beyond comprehension," said Corey Stoughton, a senior staff attorney with NYCLU, which regularly represents inmates at the Nassau County Correctional Center in East Meadow, New York.

More than 200 complaints have come from inmates about jail conditions, Stoughton said. The complaints include inmates who said they were not getting their prescription medications and handicapped inmates who said their wheelchairs were taken away.

"The problem was so systemic that we started to see these complaints weren't just instances," Stoughton said. "They were repeating the same patterns."

Nassau County's charter calls for a Board of Visitors to evaluate prisoner grievances, but the seven positions on the board were never filled in more than 20 years.

Elizabeth Loconsolo, who is general counsel for the Nassau County Sheriff's Department, said although the Board of Visitors might be vacant, several other groups oversee the jail such as the Jail Advisory Committee, Commission on Human Rights and the Sheriff's Department internal affairs unit.

"The department already works with and responds to a number of oversights at this point," she said. "It may be that the Board of Visitors was never constituted as it would just create additional, duplicative work and constitute an unwarranted burden on limited county resources."

Loconsolo said the county would respond to the specifics of the lawsuit in court.

The suit does not seek monetary damages but asks Nassau County to comply with its charter regarding the board.

The lawsuit cited four other suicides as well. It said the New York State Commission of Correction investigated the deaths and found several of them could have been prevented.

Daryl Woody, 44, who committed suicide in jail in January 2011 had a history of mental illness and was taken off suicide watch just a month earlier, the lawsuit said.

"His death may have been prevented but for the grossly inadequate psychiatric care provided him in the jail," it said.

It cited Eamon McGinn, 32, who committed suicide in January 2010 after what it said was inadequate mental and medical health care, and Gasparino Godino, 31, who hung himself with a bedsheet in October 2010 although it said officials knew his history of drug use and depression.

It also said Herve Jeanot, 29, killed himself in October 2010 after being convicted of murder in his third retrial. There is no procedure for dealing with inmates at risk of suicide after being convicted or sentenced to long prison terms, it said.

Nano-fat to fight cancer | ScienceBlog.com

For the past 40 years, radiation has been the most effective method for treating deadly brain tumors called glioblastomas. But, although the targeting technology has been refined, beams of radiation still must pass through healthy brain tissue to reach the tumor, and patients can only tolerate small amounts before developing serious side effects.

A group of researchers at The University of Texas Health Science Center at San Antonio have developed a way to deliver nanoparticle radiation directly to the brain tumor and keep it there. The method doses the tumor itself with much higher levels of radiation ? 20 to 30 times the current dose of radiation therapy to patients ? but spares a much greater area of brain tissue.

The study, published today in the journal Neuro-Oncology, has been successful enough in laboratory experiments that they?re preparing to start a clinical trial at the Cancer Therapy & Research Center, said Andrew Brenner, M.D., Ph.D., the study?s corresponding author and a neuro-oncologist at the CTRC who will lead the clinical trial.

?We saw that we could deliver much higher doses of radiation in animal models,? Dr. Brenner said. ?We were able to give it safely and we were able to completely eradicate tumors.?
The radiation comes in the form of an isotope called rhenium-186, which has a short half-life. Once placed inside the tumor, the rhenium emits radiation that only extends out a few millimeters.

But simply putting the rhenium into a brain tumor would not work well without a way to keep it there ? the tiny particles would be picked up by the bloodstream and carried away. That problem was solved by a team led by nuclear medicine physician William T. Phillips, M.D., and biochemist Beth A. Goins, Ph.D., in the Department of Radiology; and Ande Bao, Ph.D., a medical physicist and pharmaceutical chemist in the Department of Otolaryngology, all of the School of Medicine at the UT Health Science Center. They encapsulated the rhenium in miniscule fat molecules, or liposomes, about 100 nanometers across.

?The technology is unique,? Dr. Brenner said. ?Only we can load the liposomes to these very high radioactivity levels.?

The doctors hope to launch the clinical trial by summer.

Chinese writers say Apple is online book pirate

(AP) ? A group of prominent Chinese writers have demanded millions of dollars in compensation from technology giant Apple Inc. for allegedly selling unlicensed versions of their books in its online store, a lawyer said Monday.

The case is a departure from the usual pattern of U.S artists or companies going after Chinese copycats. Trade groups say illegal Chinese copying of music, designer clothing and other goods costs legitimate producers billions of dollars a year in lost sales.

Three separate lawsuits have been filed with the Beijing No. 2 Intermediate Court on behalf of 12 writers who allege 59 of their titles were sold unlicensed through Apple's iTunes online store, said Wang Guohua, a Beijing lawyer representing the writers.

The three suits together demand 23 million (US$3.5 million) in compensation from Apple, Wang said. Well-known novelist and race car driver Han Han is among the writers taking the legal action, he said.

Apple did not immediately respond to an emailed request for comment.

Wang said Apple uploaded the Chinese writers' works without their permission, violating their copyright, and while Apple deleted some of the books after the suits were filed in January, some of the works quickly appeared again, apparently uploaded by developers that sell apps through the Apple Store.

"Some developers, with whom Apple has contracts, put them back online again," said Wang of the United Zhongwen Law Firm. "It is encouragement in disguise, because they did not punish the developers. The developers could have been kicked out. But nothing happened to them."

Wang said 10 other writers have also gotten involved since January but their suits have yet to be filed. In all, 23 writers have registered their complaints with Wang and claim that Apple sold 95 pirated titles.

The official Xinhua News Agency reported late Sunday that the writers were collectively seeking 50 million yuan ($7.7 million) in compensation from Apple but Wang could not confirm that figure.

Product piracy is a major irritant in China-US relations, but usually involves complaints that Chinese are copying American products.

However, it's not the first time Chinese have cried foul over copyright infringement by an American company either. In 2009, the government-affiliated China Written Works Copyright Society complained that Google had scanned nearly 20,000 works by 570 Chinese authors without permission as part of its digital library project, drawing an apology from Google.

For Apple, the latest case is just one of several legal battles being fought in China. The company is embroiled in a battle over the iPad trademark with Proview Electronics Co., a Chinese computer monitor and LED light maker that says it registered the trademark more than a decade ago.

Proview wants Apple to stop selling or making the popular tablet computers under that name.

Apple says Proview sold it worldwide rights to the iPad trademark in 2009, though in China the registration was never transferred.

Indian tribe, developer in tug-of-war over Grand Canyon Skywalk

GRAND CANYON WEST, Arizona (Reuters) - As the muddy Colorado River flows in the plunging depths below, tourists gingerly step onto a glass walkway jutting out over the rim of the Grand Canyon for an experience that gives the illusion of walking on air.

Some pose with arms outstretched for pictures while others ease over a horseshoe-shaped skywalk that is the subject of a bitter tug-of-war between an Arizona Indian tribe on whose ancestral land it was constructed and a developer who spent at least $30 million to build it.

The tiny Hualapai nation, in a bold move that could serve as a test of the limits of the sovereign power of Native American tribes over non-members, exercised its right of eminent domain last month to take over the management of the site and kick out the non-Indian developer.

The dispute over the potentially lucrative Skywalk -- which all agree could draw up to 3,000 visitors a day -- pits the tribe's sovereign rights over a site it sees as its economic lifeblood against a developer's contractual right to manage the attraction for 25 years and share the profits.

"We've made this decision, and we've done it for what's in the best interests of the people," said Candida Hunter, 32, a member of the Hualapai Tribal Council who voted to take over the Skywalk as the dispute dragged on, abandoning a contract-mandated arbitration process.

"We've been in negotiations with them, we've tried to work with them. It was our last option really," she said of the seizure. "We just need to move forward now."

The dispute at the heart of the crisis appears to center on specifications including who was supposed to provide infrastructure -- power, water and sewer -- for the project, with both sides accusing the other of acting in bad faith.

What is not in dispute is that a visitors' center overlooking the Skywalk -- a beautiful building on the edge of the canyon with floor-to-ceiling windows where a restaurant might have been -- is nothing but a shell.

Construction on the center stopped several years ago -- the sides disagree as to why -- and the building lies unfinished and vacant, with bales of insulation piled up and gathering dust on its bare concrete floor.

Visitors who drive to the site, often as a day trip from Las Vegas, must traverse a long windshield-busting stretch on a dirt road. Others fly in by helicopter or plane to the reservation's busy airport.

LEGAL PRECEDENT

The Hualapai council members say the unfinished site is an embarrassment to the tribe, which approved the project despite some internal objections about building on land roughly 30 miles from a place central to the Hualapai creation story. Traditional tribal belief places man's origin on Hualapai lands.

"I believe the canyon is a sacred place. The Hualapai look at is as a church. Why take trash and throw it in the church. I voted against it," said Philip Bravo, a former council member. "What does the tribe have out there? A half-finished building."

Angry at the developer, the tribe passed an ordinance last year creating a legal path to effectively cancel the developer's contract through the sovereign right of eminent domain.

The tribe set compensation for the seizure at $11.4 million, a sum they said represents the fair value of a project that the Las Vegas-based developer says is worth over $100 million.

"They took everything. And then the tribal court issued an order that we were trespassers if we were even there. You do understand this is like Hugo Chavez's Venezuela, don't you?" said Troy Eid, a lawyer for the Grand Canyon Skywalk Development Corporation, which built the skywalk.

There is little doubt that tribes can legally seize property for the public good, much like a state or the federal government. But by seizing a non-tangible asset of a non-Indian company as a way to escape a contentious business deal, the tribe may have stepped into untested waters.

"I think on first glance the tribe is exercising a power that they have. Whether they are exercising it wisely is a different question," said Addie Rolnick, an expert in Indian law at the University of Nevada at Las Vegas.

But there was no clear precedent on the limit of eminent domain. Rolnick said the Supreme Court had limited the power tribes may exercise against non-members in a series of cases starting in the 1970s, and there were signs suggesting some on the court believed tribes had no power over non-members.

"But the court has never actually held that, and it certainly has not addressed the specific question of eminent domain power," she added.

The developer has sued in federal court to halt the seizure, arguing the tribe was abusing its power to make an end-run around a contract that mandates disputes be resolved by arbitration. A final resolution did not appear imminent.

In the meantime, the tribe says it is hoping to get estimates from other developers on how much it might cost to finish the visitors' center to the tribe's specifications.

Ted Quasula, general manager for the Skywalk Development Corporation who said the tribe fired him from Skywalk management as one of their first acts when they took over operations, feared the seizure could impede future development.

"I've had many other Indians from other reservations tell me that, 'What's wrong?' He puts up $30-40 million, whatever it is, and then they want to kick him out? ... It makes us look kind of ungrateful," said Quasula, himself a Hualapai tribal member.

TOURISM A MAINSTAY

The tribe initially agreed to the project to secure its economic future, and has since seen tourism revenues soar to $40 to $50 million a year, more than double what they were in 2006, the year before the skywalk opened to great fanfare, Council member Waylon Honga said.

That increase is a testament to the tribe's ability in recent years to capitalize on its prime Grand Canyon location, although it does not direct Skywalk revenue. Due to the dispute, Skywalk revenue has been paid into a trust since 2010.

In the Hualapai town of Peach Springs, where tribal members live in modest one-story matchbox-style homes often surrounded by chain-link fences, that extra money from growing tourism has translated into a building boom.

The revenues, which the tribe is keen to protect, have helped build a brand new health department and a 30-bed juvenile detention center. The tribe hopes to break ground on a child care center by the year's end, Hunter said.

The tourism money also helps fund hefty tuition payments for 81 Hualapai youth enrolled in college full-time, as well as funding for meals on wheels programs and a cultural center where youth can study the tribal language.

"Tourism is what the Hualapai tribe does," Honga said. "We don't do casino gaming, we don't have any timber or oil or coal reserves. All we do is tourism. We do the rafts on the Colorado river. We have a hotel restaurant and we have tours at the Grand Canyon."

That's not to say the tribe hasn't looked into other methods of raising its revenues. But an attempt at casino gaming in the 1990s was unsuccessful -- the Hualapai reservation is too distant from major cities yet too close to Las Vegas.

The 2,200-member tribe has also ruled out uranium mining, and its traditional commercial income dried up in 1979 when Interstate 40 bypassed historic route 66, cutting the town off from revenue from passing travelers, tribal members say. A gas station in town that once served the route sits vacant.

While some members continue to have lingering concerns about unfettered development at the canyon, others envision developing the skywalk as a convention destination - complete with a luxury hotel, golf course, and perhaps, as council member Charlie Vaughn suggests, even a revolving cocktail lounge.

When was the last time you sold a house for $135,000 above the asking price? An Australian man recently made headlines by doing just that: selling his home on Twitter.

With the help of digital marketer John Newell and real estate agent Hocking Stewart, Kurt Oprey was able to sell his home in Northcote, a Melbourne suburb, for $135,000 above the asking price by employing social media in the six weeks leading up to its auction. Though his strategy was a bit more complicated than the headlines suggest, it?s definitely simple enough for anyone with basic social media competence to employ and illustrates the future of real estate marketing in action. Here are six lessons ?the Northcote house? can teach you about using social media to sell a home.

1. Start by targeting specific keywords. Oprey?s first step was to determine the keywords that would be ?perfectly aligned with the most common search phrases used by people searching for real estate in Northcote.? He and John decided on ?Northcote, house, sale, auction? and used those everywhere, including the URL for the property?s WordPress blog, www.northcotehouse.com.au. The reason this is important is that all of the content that is created surrounding this online marketing campaign needs to be aligned with the consumer in mind. This is SEO 101.

2. Create a microsite on WordPress. A microsite helps you tell a unique story and serves as a platform for search engine optimization (SEO) and lead conversion. WordPress is one of the most flexible and widely used platforms out there; it allows you to quickly create a professional-looking website. It?s SEO-friendly and it also supports all types of media, including images, video, documents and social media widgets.

3. Build campaigns for every major medium and service. Oprey didn?t stop at a Twitter account and blog. He also created a Facebook page, a YouTube channel, and Flickr, Picasa and Posterous accounts for the Northcote house. By creating multiple sources of photo, video and written content, Oprey ensured that the Northcote house would show up in any kind of search and on just about any website or service. Oprey also devoted enough time to each channel to make sure they all ranked No. 1 for his keywords in Google.

4. Collaborate to make it personal. Traditionally, sellers and buyers are discouraged from personal contact in order to prevent any interactions that could jeopardize the deal. But social media provides a certain amount of distance between people, allowing you to use a more personal touch in highlighting the features of a property. The agent took advantage of this by working with the owner to capture personal stories about the home for use on Twitter, Facebook, YouTube and the blog.

This made the house stand out and gave the campaign content that the agent would have been hard-pressed to create on his own. A blog post was created, with the title: ?Why you might want to live here by people who have,? and the owner?s personal stories, photos and videos about the Northcote house were also posted.

This communication with the owner allowed him to share what he loves about the house: inside, outside, what?s great about living there, the change of seasons, what?s nearby, the community ? everything from the owner?s point of view. The house, in this way, can become more than a collection of rooms ? it becomes a home in a buyer?s eyes.

5. Share and Share Often. Woody Allen said, ?Eighty percent of success is showing up.? When talking about social media, I think ?80 percent of success is being consistent.? Posting regularly helps you build interest and followers over time, and ensures you remain at the top in searches for your keywords. Oprey, for his part, posted stories daily ?on a range of subjects designed to inform potential buyers about the house and increase their interest in the property.?

6. Don?t do this alone. Owners might be tempted to think that they don?t need a real estate agent, and agents might be tempted to think that they don?t need marketing help. Oprey worked with an agent and a marketer on the Northcote house for good reason: Creating compelling content on multiple platforms is a time-consuming endeavor and needs to be agile to be effective.

The future of real estate marketing will have all parties playing their part in the process: owners sharing stories to personalize and add emotional content about their home; marketers tying the online efforts together in ways that drive interest and leads; and the agent, orchestrating the entire process, connecting all the right dots to serve the customer and bring a successful deal to a close.

If this seems like a lot of work to you, it is. But it?s no different than the mountain of work that you are already doing to sell a house. It?s just a matter of focusing on where the customers are spending their time: online. Use these six steps as a checklist.

Well NOW it?s official, we are building a house. Today we signed the building contract; this means our contingency for purchasing the lot is satisfied and we can move forward! (Wife Comment: YAY!)

Yesterday, we took the day off and visited Nonn?s? Designer Showplace for a second time. Last time we selected counter tops and cabinets. This time we were looking to nail down flooring, trim, doors, and exterior finishes. There were many of choices that we never even thought of; window color, trim shape, shake colors, etc. Tamara Nonn was amazingly helpful selecting colors and materials. Based on the other finishes we had chosen and with Tamara?s opinion, we actually decided to back track and change one of the countertops. At this point, you?ll have to wait and see what we chose!

After that we grabbed a bite to eat (Sofra in Middleton ? check it out!) and headed to the builder?s office. Dave at Trademark Homes walked us through the specifications, contract, and pricing. His pricing was all based on the finishes we selected and bids from his sub-contractors (exteriors, electrical, plumbing, framing, etc). We ended up $3,000 over our maximum planned budget. This pricing was a little conservative, considering we selected countertops that where a hair less than budgeted. We also thought we could spend a little less on light fixtures since Kinsey?s step dad, with Isthmus Electric, would get his discount. We thought we maybe had $1000 worth of adjustment in there.

We were still $2000 over our max budget and this number didn?t factor in our washer and dryer, which we figured $1000 more for. So, we started talking about all the things we had added, and what we could cut out. We went through every option to cut cost. It was $200 here, $400 there, and it took deleting 5 or 6 features to hit our target. It didn?t seem worth it to sacrifice what we want in a house (the whole reason we are building) for a couple thousand dollars. The items we considered cutting (garage windows, soft close drawers, 3 panel doors, fireplace, tray ceiling, taller basement, basement window etc.), would have cost far more to add later. We negotiated pricing with the builder a bit more and ended up with a decision. We agreed to $1000 over our max for the house and appliances. This included everything we wanted. Although, I think we added in more than we planned on when we originally started. I hate spending more than planned, but $1000 extra is a small price to pay for everything we want in a neighborhood we love. ?and it?s still about $10,000 less than comparable homes in the neighborhood.

The next steps? appraisal, insurance, lot closing, and start digging.

We are very excited to get things rolling! A happy wife equals a happy life right? ;)

Biblical relic dealer acquitted in forgery trial

An Israeli antiquities dealer accused of forging biblical and early Jewish relics has been acquitted of the charges, a verdict that is unlikely to dampen the controversy over whether the items, including a box supposedly containing the bones of Jesus' brother, are real.

The Jerusalem District Court ruled Wednesday that Oded Golan could not be proven guilty of forging inscriptions on a funerary box, or ossuary, and on a stone plaque supposedly from the First Temple, the main temple in ancient Jerusalem. According to the Hebrew Bible, the temple was constructed by King Solomon and was renovated in that late ninth century B.C. The plaque allegedly dates from these renovations. If real, the plaque would be the only surviving archaeological evidence of the temple.

Golan was found guilty of three lesser charges of possessing stolen property and violating antiquities law. But despite a judgment by a panel of experts convened by the Israel Antiquities Authority (IAA) that the items are forgeries, the court concluded that there was not enough evidence to conclude that Golan had faked them.

The authenticity of the ossuary will "continue to be investigated in the archaeological and scientific arena, and time will tell," the court concluded, according to Reuters' reports.

"It appears that the judge did not rule on the question of whether the ossuary is authentic," said Nina Burleigh, a journalist and author of " Unholy Business : A True Tale of Faith, Greed and Forgery in the Holy Land" (Collins, 2008). "He explicitly states that he wasn't ruling on that."

Nonetheless, Burleigh said, the verdict will likely be a setback for the IAA and for authenticating archaeological finds in general. She cited an interview she conducted for her book with Tel Aviv University archaeologist Israel Finkelstein.

"He said, 'When there is an acquittal, which there probably will be, the market in these relics will be quiet for awhile,'" Burleigh told LiveScience. "'And then it won't be long before you see announcements internationally that Solomon's sandals have been found, and Mohammad's sword.'"

Questionable relics
The forgeries saga began in 2002, when Toronto's Royal Ontario Museum exhibited the ossuary, bearing the Hebrew inscription "James son of Joseph, brother of Jesus." Golan claimed to have bought the ossuary from a dealer in the 1970s, only realizing its importance three decades later.

The relic was a media sensation, but archaeologists started raising alarm bells. The fraud unit of the Israel Police launched an investigation in conjunction with the IAA's Unit for the Prevention of Antiquities Robbery. According to the IAA, the investigation turned up evidence of a loose forgeries ring, in which Golan and others would alter antiquities with inscriptions to make them seem more valuable; for example, adding "brother of Jesus" to the ossuary belonging to "James son of Joseph."

The case prompted the Israel Museum to evaluate some of its artifacts to re-check for evidence of forgery. The investigation turned up evidence that a carved ivory pomegranate, bought from an anonymous collector and once attributed to the First Temple, bears a forged modern inscription (though the pomegranate carving itself is ancient).

But for all the evidence of forgeries and the definitive fakes revealed in the trial, Israel Police and the IAA did not have the resources to "nail down the case," Burleigh said.

"The authentication of ancient objects is not the No. 1 priority," she said. "It's not even in the top 20 of what they're focused on. Israel is a challenged country."

On the stand, she added, the prosecution leaned heavily on the testimony of individual archaeologists. Defense lawyers were able to pick at the scientific evidence, making the authenticity of the ossuary and other objects seem more in doubt than it actually is.

"They quibbled over these tiny details, and the defense attorneys, who were very well-paid people, they were able to impeach almost every one of these very highly regarded scientists on the stand," Burleigh said.

Ongoing arguments
Though the number of scholars who believe that the ossuary and temple plaque are genuine has dwindled, there are a few interested parties who still argue vociferously for their authenticity. The lack of a guilty verdict seems likely to throw fuel on these debates.

Hershel Shanks, editor of the magazine Biblical Archaeology Review, which published the original article introducing the ossuary, wrote an article blasting the IAA's conclusions on the magazine's website.

"Despite all that I have said, the inscriptions I have discussed will be considered forgeries in the public mind for at least a generation ? never mind the acquittal of the defendants and the evidence of authenticity," Shanks wrote.

The IAA argues that good has come out of the Golan case. The field of archaeology took a hard look at publishing papers based on artifacts from the antiquities market, especially without detailed information on where the objects were found, the IAA wrote in a statement responding to the verdict on Wednesday. This, in turn, has made illicit excavations less profitable, reducing robbery at biblical sites, the agency said.

That's fishy: Feds fight fraud in seafood sizes

(AP) ? Those plump and tempting scallops behind the fish counter glass might be a lot smaller than they look ? a sodium-based compound can bloat scallops well past their actual size. And that pollock fillet isn't such a good deal if the price includes the layers of ice glazed onto it to keep it fresh.

This "overglazing" rips off consumers, as does so-called "soaking" of scallops, which can also alter the taste of the shellfish. At the International Seafood Show in Boston this week, a top federal seafood quality officer announced his agency was increasing efforts to stop these and other types of seafood fraud.

"We've decided we're going to take on the economic fraud concern," said Steven Wilson, chief quality officer at the National Marine Fisheries Service's seafood inspection program.

Perhaps the best known kind of seafood fraud is species substitution, when sellers secretly replace a prized species with a similar tasting, cheaper fish ? say, whiting substituted for grouper, or mako shark for swordfish.

But fraud involving inaccurate food weights, caused by practices such as overglazing and soaking, is far more common, Wilson said. Inspectors at his agency find some kind of economic fraud in at least 40 percent of all products submitted to them voluntarily. And in at least eight out of 10 of those cases, inaccurate weights are the problem, he said.

"If we focus on the net weight issues we'll drop that 40 ... percent to very, very minor percentages," Wilson said.

The problem with detecting the soaking or overglazing is that both involve legitimate ways to keep seafood fresh, so it's tough to tell when someone is cheating.

The law says a package labeled as 10 pounds of fish must contain 10 pounds of fish, with the ice glaze as extra, uncounted, weight. But the only way to know whether the ice is being counted is with labor-intensive inspections that match the fish weight with the weight advertised on the package.

That happened in 2010, when an investigation by 17 states showed customers were often charged for the ice in seafood packaging, sometimes as much as $23 per pound. In the four-week investigation, 21,000 packages of seafood were removed from shelves.

"This sounds like something that is so simple, and so sort of pedestrian in the world of fraud, you would think ... people wouldn't get away with it," said Gavin Gibbons of the National Fisheries Institute, a seafood trade association. "But it is absolutely a challenge."

The soaking of scallops and other seafood, such as shrimp and even whitefish fillets, involves moisture retention agents that keep seafood fresh.

It's tough to define how much is too much for a given species, but their use can be abused. Wilson described a scallop as "a little sponge" that can absorb as much as half its own weight in water. The truth about these bloated scallops becomes clear when they hit the frying pan, shrink and their water burns off.

"You're paying for water that's going to disappear when you cook the product," Wilson said.

Since about two-thirds of the water-retention compounds are sodium-based, they can also add a saltiness to the seafood that isn't natural, but which some research has shown consumers see as normal, and even prefer, Wilson said.

"If this goes on long enough, the consumer thinks it's normal, when it's not," he said.

Both problems are hard to detect, so they're also tough to stop.

Most seafood eaten in the U.S. is imported and packed outside the country, so regulators here can't prevent any fraud. And the more fraud there is, the more industry members feel pressure to commit it to compete.

Once seafood arrives in the U.S., the Food and Drug Administration regulates it. But that agency's resources are often consumed by more urgent concerns, such as food safety and bioterrorism, according to a report by the Congressional Research Service. The report said just 85 of the FDA's 1,350 inspectors work mainly with seafood.

"Enforcement of economic fraud and labeling laws may be a lower FDA priority relative to protecting the health and safety of the U.S. food supply," said the 2010 report.

Lisa Weddig of the Better Seafood Bureau, an arm of the fisheries institute, said public and industry awareness can make a difference because complaints lead to action. The 2010 study on overglazing, conducted in consultation with the FDA by the different states, is an example.

She added that while the National Marine Fisheries Service doesn't have authority to regulate seafood fraud, it can cut down fraud by awarding certifications for seafood that meets voluntary quality standards it devises.

Weddig said that because fraud affects both the value and taste of seafood, and the industry wants to say it's delivering the maximum amount of both, it has major motivation to comply with the voluntary standards.

"If you serve poor-quality seafood to consumers, it might be the last seafood meal they eat," Weddig said. "And nobody wants that to happen."
